Purpose
Your data will be processed to respond to your inquiries and send requested information. In the case of contracting our products, data will be processed to manage and control the established relationship (insurance contract); we may also send you advertising for other products and services marketed by INSURAMA. If theft or robbery coverage is contracted, geolocation processing will be required. The client must have the INSURAMA app installed on the insured device with geolocation enabled, as, in case of an incident, we must have geolocation coordinates sent from the insured device via the INSURAMA app on the day of the incident and at least five days before the date of the theft or robbery.
Legitimacy
- If you contract our services, the legal basis for processing your data is the execution of the insurance contract (GDPR Art. 6.1.b).
- If your contract includes theft and robbery coverage, the client must have the INSURAMA app installed on the insured device with geolocation enabled. In the event of an incident, we must have geolocation coordinates sent from the insured device via the INSURAMA app on the day of the incident and at least five days before the date of the theft or robbery. This is legitimized by the contract and consent upon acceptance, as well as by the legitimate interest in fraud prevention (GDPR Recital 47).
- Insurama may also process your data in legitimate interest, limited to updating or informing about contracted services (GDPR Art. 6.1.f). Marketing of other product and service offers is based on consent, which will be specifically requested in each case; consent can be withdrawn at any time with no retroactive effect and without affecting the execution of the subscription contract (GDPR Art. 6.1.a).
- In these cases, and based on Article 21 of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce, such information may be sent via email, SMS, or any other electronic or telematic means, including direct telephone contact.
Types of Data Processed
The types of data processed will be those provided in the forms you fill out for the respective purposes. If an online contract is executed, the user’s device IP address will be stored for evidentiary purposes and as a fraud prevention measure; additionally, if theft and robbery coverage is contracted, mobile geolocation must be activated. This communication is essential to enable the insurance contract. Providing data for the aforementioned purposes is necessary to maintain the contractual relationship; failure to activate geolocation may result in the loss of certain insurance coverage.
